2 Children Killed in Multi-Vehicle Crash with FedEx Truck in Senatobia, MS
Local news reports indicate two children were killed following a
multi-vehicle wreck involving a FedEx truck in Senatobia, Mississippi.
The accident occurred around 12:09 p.m. Thursday, October 27 when police
state a green Saturn was rear-ended by a FedEx truck. The driver and
her 15-year-old passenger were treated at the scene, however two
children in the back seat, ages 2 and 7 were killed in the incident. The
accident remains under Senatobia Police investigation.
Commentary The news
reports do not go into any great detail regarding how the accident
occurred, which could make the necessity for a third party investigation
even more crucial. When an accident involves a commercial vehicle,
several theories of liability could exist, which includes the
possibility of multiple at-fault parties. A rear-ending
accident should point the investigation straight to an inspection of the
FedEx truck. Certainly if a driver was found to be inattentive or
distracted before the accident they could face fault, but others may not
realize that an owner of a company has a responsibility as well that
could come into question. As mentioned, the inspection should target the
braking system of the vehicle, and crosscheck maintenance records with
the measurable wear of the brakes. If an inconsistency is found such
that points towards maintenance that could have prevented the accident,
an employer as well as the employee could be found liable. When dealing
with a company that owns a fleet of vehicles, an inspection like this
must occur, as a driver should not incur all of the fault if his vehicle
is under-maintained. They may seem innocuous in regards to
accident fault, but in reality employers are included into commercial
vehicle accidents all the time because of some oversight. Not only does
finding an oversight help to compensate a tragedy, but it also shores up
the procedures at the company in question.
