Eduardo Devora Killed in Auto Accident in north Houston, Texas
According to the Houston Chronicle, a man was killed in an accident with
an SUV that allegedly ran a red light in north Houston, Texas. The
accident occurred early Sunday morning, October 23 when Harris County
Sheriff's Deputies believe Eduardo Devora was killed in the collision on
Veteran's Memorial Drive. Sheriff's believe Devora was attempting to
make a left turn, when a green-colored Ford expedition ran a red light
and struck his vehicle. Devora was taken to Ben Taub General Hospital
where he later died.
Commentary When an
accident occurs at the hands of another party's alleged negligence, an
independent investigation should be conducted following the police
reports, in an effort understand all the possible civil remedies. If the
reports are accurate and the driver of the SUV ran a red light, they
could be found liable in a wrongful death claim. To be
successful, a claim needs to identify a liable party. From there, the
value of the separate investigation is revealed because the next step in
a wrongful death claim is determining negligence. A general explanation
of negligence is a party allowing their standard of care regarding
safety (relevant to this accident, their care on the roadway) to fall
below what a reasonable person would expect. This is probably the most
combative point of a wrongful death claim by defense attorneys, whose
job is to toss out ulterior reasons for the accident to mitigate
liability or payouts. An investigation that can contradict any effort to
skirt fault is paramount to winning a claim. From there, the only
remaining factors for a wrongful death action are survivors who are
eligible under Texas law to file on the victim's behalf, and they must
be able to show actual loss of finances resulting from the wreck. This
could allow recovery of damages like funeral costs, loss of financial
support the victim provided, or medical bills incurred before the
victim's death.
