Teresa Dutton Killed in Two-Vehicle Rollover Accident in Idalou, Texas
According to local news reports, a woman was killed and her
granddaughter seriously injured in a rear-ending collision in Idalou,
Texas. The wreck occurred around 2 p.m. Monday, October 24 when the van
of 60-year-old Teresa Dutton was struck from behind by a pickup truck,
driven by 57-year-old Larry Elkins. The collision caused the van to roll
at least three times, partially ejecting Sutton, and breaking the leg
of her 10-year-old granddaughter in the vehicle. Three other children in
the vehicle were uninjured.
Commentary It is
remarkable 3 of the 4 children in the van were uninjured in this
accident. On these West Texas roads, where the speed limit constantly
fluctuates as you leave town, drivers must be careful to keep an
appropriate distance between them and the vehicle in front. If the
reports are accurate and the woman was attempting to make a turn from
the roadway when she was struck, it is possible she was not given enough
clearance to complete the turn. To zero in on this potentially
negligent action, an independent investigation is needed to formulate a
strategy regarding a civil remedy to the accident. These
remedies require a party to be found liable in an accident, and with a
negligence determination, there is usually standing for a wrongful death
claim. These claims are very dependent on the police reports and
