I question whether performing a U-turn in the middle of a highway is a safe maneuver. When a dangerous action is cited as one of the causes of an accident, a third party investigation is needed to work in collaboration with the police reports to develop a strategy going forward regarding civil remedies.
The reason I advocate a separate investigation is because its determination can often form the basis of a prospective claim. To have standing in a wrongful death claim, a victim's death must be because of a negligent action or inaction by a liable party. To arrive at a level of negligence, the investigation would need to cite an action that falls below the safety level of what a reasonable person would expect on the roadway. Once this is established, a claim needs eligible survivors (under Texas state law) to bring a claim on the victim's behalf and those survivors must be able to show a tangible economic loss from the accident. Without any one of these elements, a wrongful death claim typically cannot commence.
