Plane Crash Kills One Man, Injures Others in Carrollton, Texas
According to WFAA, one man was killed and two others injured in a plane
crash in Carrollton, Texas. The crash occurred around 11:35 a.m. Monday,
October 24 when the plane went down shortly after taking off from
Addison Airport. The plane, a Cirrus SR22, crashed with 3 male
passengers inside, killing 47-year-old passenger Richard Goodrum, and
injuring 40-year-old pilot Hemant Vankawala. The other passenger injured
has not been identified. The National Transportation Safety Board is
investigating the accident and notes that the equipped parachute did not
fully deploy.
Commentary Though
plane crashes require very in-depth investigations to recreate the
incident and determine a cause, their remedies available thereafter take
on relatively the same fashion as a wrongful death or product liability
claim. The first thing the investigation would address is
whether the on-board parachute's failure to deploy was a mechanical
malfunction. The chute's failure could implicate a manufacturer in a
civil claim, as that deployment could conceivably have prevented a
tragedy. Furthermore, any discussion of possibly implicating a
manufacturer should also come with an examination into the plane's
maintenance work, as failure to service an airplane properly could lead
to other contingencies. An owner who is negligent in providing
maintenance or a service crew who failed to address some key aspect of
the plane's safety features could all share some level of liability in a
plane crash. Again, plane crashes are certainly less common than say
18-wheeler accidents, but after they occur, they require the same level
of diligence in investigation and award some of the same types of
damages in a successful civil suit.
