Pedestrian Killed in Hit-and-Run Accident along Sam Houston Parkway in Houston, TX
Local news reports indicate a woman was killed in a hit-and-run
collision in Houston, Texas. The accident occurred around 7:45 p.m.
Sunday, October 23 when the unidentified 44-year-old woman was
attempting to cross the service road of Sam Houston Parkway when she was
struck by a car, which then drove away. The woman was taken to Ben Taub
General Hospital where she was later pronounced dead. Houston police
continue to investigate the accident.
Commentary Hit-and-run accidents are particularly frustrating, as a
suspect is still on the loose and evidence may be tampered with. Some of
these types of incidents we have litigated in the past found a driver
with more to hide than just the charge of failing to render aid. With so
many possible outcomes involved in a hit-and-run collision, an
independent investigation should be conducted with the police reports to
establish a clear picture of liability. This is essential in providing a
framework for any prospective civil remedies that may be available to a
victim's survivors. To have standing in a wrongful death
claim, a victim's death must be the result of a negligent party's
actions or inaction. This speaks to the investigation, as several
factors are involved, including where the victim was in the roadway and
certainly where the vehicle was traveling at the time of the accident.
Furthermore, a claim must have survivors who are eligible under state
law to bring a claim on the victim's behalf, and these survivors must be
able to show tangible economic loss because of the accident.
A successful wrongful death claim could provide compensation
in the form of funeral costs or loss of financial support the victim
provided, as well as survival damages like property damage or lost
wages.
