Two Dead Following Accident with Passing 18-Wheeler in Franklin, Texas
Local reports from KXXV indicate a two people were killed in an accident
with a semi truck in Kosse, Texas. The accident happened around 4 p.m.
Wednesday, October 19 when Texas DPS believe the 18-wheeler tried to
pass a Dodge pickup truck hauling a load of hay. The pickup tried to
make a left turn from the highway but was struck by the rig on the
driver's side and sent off the road. Officials state the pickup then
ignited, trapping both occupants inside the vehicle. Their names have
not been made public.
Commentary I wish I
could say that I'm shocked by this level of aggressive driving, but my
experience handling these matters does not allow it. In commercial
vehicle accidents, negligence is manifested in many forms, extolling the
necessity for the incident to be looked at by a separate investigation.
The first thing that should be checked is whether this area
of road is a no-passing zone. I find it peculiar, if not downright
dangerous, that passing could occur in an area with turn-ins and
perpendicular roadways. If the investigation finds a truck driver who
became overzealous towards their haul, behind a vehicle making a smaller
haul of their own, there could be fault found against the trucker. I
realize haul times mean everything in this business, but they do not
mean operating a vehicle dangerously. To have a wrongful death
action against a party, a victim or their survivors must be able to
show that liable party acted negligently in the accident. The burden
rests on the plaintiff, which explains why the investigation is
imperative to a claim because liability will be viciously disputed by
defense attorneys. By the way, depending on the trucking company that
owns the rig, there may very well be defense investigators and attorneys
on the scene currently, trying to mitigate their client's liability.
This is all done with an eye towards the bottom line of a company, as
chipping away at any level of payout is considered a victory but could
undercompensate victims or their survivors.
