Halley Catherine Shaw Killed, Two People Hurt in Crash From Suspect Fleeing Police in Houston, Texas
According to the Houston Chronicle, a woman was killed and two other individuals injured in an accident with a suspect fleeing police in Houston, Texas. The accident occurred around 11:30 p.m. Tuesday, October 18 when a patrol vehicle was investigating two occupants of a car. The passenger exited the vehicle, but the driver fled, later running a red light and slamming into another car. The back-seat passenger of the car was killed, while the driver and another passenger were taken to a nearby hospital. Their conditions are currently unknown. Houston police are still searching for the fleeing suspect, who ran following the crash. The victim's names have not been identified, pending investigation.
Update: The victim has been identified as 27-year-old Halley Catherine Shaw.
Commentary Houston experimented with no-chase laws in 2006 but were found to be of concern from the Houston Police Officer's Union. As evidenced in this tragedy, even if the city had no-chase laws on the books, if a suspect wants to flee, they will flee. Once the police catch the individual (and make no mistake, they will), a third party investigation is needed in developing strategies geared towards potential civil remedies. These remedies are contingent upon a negligence determination, placed on a liable party. Negligence is observed when a party's actions or inaction towards (in this matter) safe operation of a vehicle, falls below what a reasonable person would expect. This can be manifested in a number of ways, like errant driving, speeding, intoxication, or a number of others. Many of the hit-and-run collisions we have litigated found a defendant who was reckless well beyond that of inattentiveness, helping the plaintiff's matter. With this information of negligence, survivors (if they are eligible under Texas law) may be able to bring a claim against a liable party if they can show tangible economic loss in the accident. A successful claim produces twofold results. First, a party is punished for their negligence in a victim's death, and second, a family can be compensated with regard to the tremendous financial obligations associated with the loss of a loved one.
