Passenger Daryn Barnett Killed in Accident with Suspected Drunk Driver in Indianapolis, Indiana
According to Fox 59, a woman was killed and a man was arrested for operating a vehicle while intoxicated causing death, after a one-vehicle collision in Indianapolis, Indiana. The accident occurred around 5 a.m. Tuesday, October 18 when 18-year-old Daryn Barnett was killed riding in a vehicle with suspected drunk driver, 21-year-old Samuel Mack. Police believe Mack lost control of his vehicle and struck a tree on the passenger side of the car. Police continue to investigate the accident.
Commentary What a terrible accident. Not that I want anyone injured in any accident, but it seems like more often than not the drunk driver walks away from the wreck. Once the police reports are completed, they will establish if the driver was indeed intoxicated. Following that assessment, a third party investigation is needed to develop a strategy for survivors of the victim going forward. If the man was driving his vehicle under the influence, he could face great liability in the accident, as the law views this as a reckless action. The reason the investigation is so crucial is because the law requires a determination of negligence on behalf of a liable party to have standing in a wrongful death claim. A claim must be brought by state-defined eligible survivors who can show the court they lost tangible finances in the accident. If successful, a wrongful death claim can compensate a family in areas like funeral costs, any medical bills incurred before death, or pain and suffering the victim endured, to name a few.

Being a close friend of the victim, I know for a fact that the male driving the car had been making frequent death threats to Daryn for several days. Where would this come into play in an investigation?

I was very close to Daryn, and the driver was NOT a stranger to her and had been threatning her, I do not want to see him walk away...
