Jose Eleno Gonzalez Killed in Hit-and-Run Collision in Bellmead, Texas
According to local news reports, a pedestrian was killed in a
hit-and-run accident in Bellmead, Texas near Waco. The accident occurred
before 8 p.m. Sunday, October 16 when police found the body of

Commentary Hit-and-run accidents are particularly frustrating, as not
only is any closure from the accident delayed, but evidence could be
tampered with. An incident of this nature requires a third party
investigation to recreate the scene and determine liability. A number of
possibilities could factor into the cause of the collision, including
excessive speed, an inattentive driver, or one under the influence. The
investigation works in concert with the police and their reports to
determine who was at fault. This is an invaluable tool for a
family in developing a strategy going forward, as the reports and
investigation will most likely determine if there is standing in a
wrongful death claim. For this type of claim, the victim's death must be
the result of a party's or parties' negligent action or inaction. The
emphasis here is on the word negligent, as a level of safety (in this
matter on the roadway) must fall below what a reasonable person would
expect. If that is determined, all that remains for standing is the
victim must have survivors who are eligible, under Texas law, to bring a
claim on the victim's behalf, and must be able to show tangible
economic loss as a result of the victim's death. A successful claim can
award damages like funeral costs, medical bills incurred before the
victim's death, or loss of financial support the victim provided.
