Toddler Ivyana Sheppard Killed in Rear-End Collision in Waco, Texas
According to KXXV, a toddler was killed when the car she was riding in was rear-ended in Waco, Texas. The accident occurred around 9 p.m. Saturday, October 15 when the vehicle of 24-year-old David Sheppard was rear-ended by 40-year-old David Martin. The impact of the accident caused Sheppard's car to burst into flames, injuring 2-year-old Ivyana Sheppard inside. A witness at the scene took three injured individuals from the car to Hillcrest Baptist Hospital where the toddler was pronounced dead. The condition of the others involved in the collision are unavailable.
Commentary What a horrible accident. I hope those who were injured recover fully and my condolences go out to the family of the young child. Having children of my own, this incident particularly stings. When a collision of this magnitude occurs, an independent investigation is needed to make a liability determination. Other news feeds have mentioned alcohol as a possible cause of this accident. While these are only allegations at this point, the police reports will examine this link. It should be noted that alcohol or some other intoxicant is not needed to seek recourse from the accident. What is actually needed is a negligence assessment by the investigation. This is provided when an examination finds a driver's operation of their vehicle with regards to safety, to be under what a reasonable person would expect. If this is found, the remaining components of a wrongful death motion are survivors of the victim who are eligible to make a claim and can show a loss of income due to the accident. Furthermore, there may be one other effect of this accident. The report notes the collision caused the car to ignite, which may have led to further injury. The investigation would need to inspect the vehicle for certain manufacturing defects or design flaws, as automobile accidents do not typically lead to a fire. If a link can be determined between a faulty vehicle and the injuries in question, there may be a possible claim against a manufacturer as a result of the event. Regardless of the outcome of the incident, this is a terrible tragedy that no level of compensation can fix. However, the added burden of financial obligations that result from the loss of a loved one should not have to be shouldered as well.
