Motorcyclist Killed in Collision with Pickup Truck in Del City, Oklahoma
According to News OK, a motorcyclist was killed after he crashed into a
pickup that had just changed lanes on Interstate 40 in Del City,
Oklahoma. The accident occurred around 8 a.m. Friday, October 14 when
the pickup experienced a tire blowout and shifted into the right line of
the interstate and was then hit by the motorcycle. Oklahoma Highway
Patrol state the man was killed at the scene, and that they have
arrested the driver of the pickup. The victim's name has not been
identified, pending investigation.
Commentary The
details of this tragedy prove the necessity of an independent
investigation, as what some may view the cause of the accident is not
always the case. For whatever reason, my experience has told me most
associate motorcycle accidents with a reckless or speeding biker. If the
reports are accurate, this may not be true here. For a party
to have standing against another, a plaintiff must prove that a party
was negligent in the victim's death. Negligence is established when a
party's level of care in a situation (in this instance the safe
operation of a vehicle) drops below what a reasonable person would
expect. As my readers can imagine, a determination like this requires
the investigation to work in corroboration with the police and their
reports, in an effort to identify liability. If negligence is found, a
wrongful death claim only needs eligible survivors (according to the
state's laws) who have incurred an actual economic loss from the
accident to proceed.
