Construction Worker Killed by Suspected Drunk Driver in Houston, Texas
According to ABC 13 Houston, a construction worker was killed when an
alleged drunk driver traveled into a construction site in Houston,
Texas. The accident occurred around 3:30 a.m. Sunday, October 16 when
Houston police believe 34-year-old Allen Kwan drove into the zone and
struck the 33-year-old worker, killing him on the scene. The victim's
name has not been released, pending investigation by OSHA.
Commentary If an
accident occurs on the job by a party not affiliated with the employee
or employer, a third party investigation is needed to determine all
liable parties. The results of an accident like this could produce
multiple outcomes, one of which has been satisfied by the report that
the employer has filed a workers' compensation claim. A workers' comp
claim is a no-fault motion which will make a percentage calculation
against the worker's salary and compensate a family. Unless benefits are
being withheld, administrative motions for workers' comp may not need
an attorney. On the other hand, another outcome of this
accident could be a claim against the driver of the vehicle. To be able
to file a claim of this nature, a victim's death must be the result of a
negligent party's actions or inaction, the victim must have survivors
who are eligible for this motion, and they must be able to show tangible
monetary loss from the accident. A wrongful death motion is geared
towards damages like funeral costs, any medical bills the victim
incurred prior to death, or loss of financial support the victim
provided his family, to name a few. Furthermore, though these
are only allegations at this point, if the driver of the errant vehicle
was indeed intoxicated, there could be yet another outcome of this
accident. Again, if the police link the wreck to a drunk driver, and if
the separate investigation finds a driver at a bar or restaurant prior
to the accident, that entity could also be partially liable. Texas has
laws in place, known as dram shop laws, which could find an
alcohol-serving entity partially liable if they are found to over-serve a
patron past the point of intoxication. I mention partially liable, as
the laws do not remove fault from a drunk driver, but rather hold a bar
accountable to rules dictated by the TABC. A claim against a bar or
restaurant can further compensate a grieving family, as well as
potentially prevent a future accident by making those establishments
think twice about over-serving a
patron.
