Driver Killed in Stalled Vehicle Accident on Interstate 45 in Houston, Texas
According to local news reports, a man was killed while working on a disabled vehicle on Interstate 45 in Houston, Texas. The accident occurred around 8:40 p.m. Friday, October 14 when the man was rear-ended by a red truck who then fled the scene. The impact sent the man over the edge of the highway and onto the feeder road below. The victim was taken to a local hospital where he was later pronounced dead. The hit-and-run driver was later apprehended and given a field sobriety test.
Update: The hit-and-run driver has been identified as 37-year-old Michael Anthony Flores.
Commentary When a hit-and-run accident occurs, the necessity for an independent investigation increases. Normally, when a driver flees the scene of an accident, it is not simply due to a poor choice, but rather the burden of other issues. From my experience in the past, hit-and-run accidents have produced drivers who were intoxicated, or attempting to dodge a warrant, or avoiding a charge like possession. Certainly the news feeds do not support any conclusion like this, but a 20-year hunch in this business allows me to guess at the cause here. Even without the added contingencies that are potentially manifested in a hit-and-run wreck, there may still be standing here for a wrongful death claim. For a wrongful death claim to commence, a few key elements must be met. First, a victim's death must be from the negligent actions or inaction of another identifiable party. The emphasis here is on negligent, as the investigation must find a party whose appropriate level of care on the roadway fell below what a reasonable person would expect. From there, the victim must have survivors who can bring a claim, under Texas law, and they must be able to show actual economic loss as a result of the accident. Typically the exclusion of even one of these elements can prevent standing in a wrongful death claim.
