Man Killed After Initial Accident on Interstate 45 in Houston, Texas
According to the Houston Chronicle, a man was killed when an accident
occurred after a minor incident happened in Houston, Texas. The wreck
happened around 12:30 a.m. Thursday, October 13 when a man lost control
of his pickup truck and struck a wall on Interstate 45. Another man
stopped to help the stranded motorist. As the driver of the pickup began
to survey the damage to his vehicle, his vehicle was struck by a car,
which hit the man, killing him on the scene. The two other drivers in
the accident were injured, but their statuses are unknown currently.
Commentary It is a
tragedy when a good deed turns into a bad accident. I hope the injured
make a full recovery, and my condolences go out to the deceased's
family. I certainly understand the dangers of breaking down on the
highway, especially one in Houston. However, if a motorist stays on the
shoulder, I do believe they have a reasonable expectation of safety
while trying to rectify the situation. In a situation like this,
stranded motorists have no other choice but to hope drivers are
operating around them in a safe fashion. When a fatality (or
injury) occurs by the alleged actions of another party, an independent
investigation is needed to link that event to the party. This link is
what could form the basis for a wrongful death claim. To have standing
in a wrongful death motion, a victim's death must be attributed to a
party's negligent action or inaction. From there, the victim must have
survivors who are eligible, under state law, to make a claim on the
victim's behalf. They must also be able to prove actual economic loss as
a result of the accident. Without any one of these elements, a wrongful
death suit normally cannot proceed.
