Rachael Michelle Dumouy Killed, Dwanye Gabriel Hurt in Collision with Suspected Drunk Driver in Galveston, TX
According to the Galveston Daily News, a woman was killed and a man was
injured in a collision with a suspected drunk driver in Galveston,
Texas. The accident occurred around 6:30 p.m. Thursday, October 6 when
28-year-old Rachael Michelle Dumouy and 30-year-old Dwayne Charles
Gabriel were struck by an alleged drunk driver. Police believe
28-year-old Lizbeth Perez lost control of her vehicle, struck a light
pole and then swerved into oncoming traffic, striking the car of Dumouy
and Gabriel. Gabriel was taken to University of Texas Medical Branch's
John Sealy Hospital, where his condition is unknown. Perez was uninjured
in the accident and charged with intoxication manslaughter.
Commentary What a
terrible accident. I hope the driver of the other car experiences a full
recovery. As far as the errant driver, they could face liability in the
accident. An independent investigation is needed for recreation
purposes, while the police will follow up on the intoxication charges.
An investigation will seek to reconstruct the scene and make a
negligence determination. If a driver is found to operate their vehicle
beyond the scope of what a reasonable person would expect with regards
to safety, they may be found negligent in the action, and liable for
civil claims. Without the alcohol charge, this determination is very
dependent on the police reports and investigation, as the accident is on
a much more even playing field. However, if the intoxication link is
confirmed, the law could see this singularly as negligent.
With this designation, one of the pillars of a wrongful death
suit is satisfied, as the victim in an accident must have been killed by
a party's negligent inaction or actions. If the victim has survivors
who are eligible under Texas law to make a claim on their behalf and can
show tangible monetary loss from the accident, a wrongful death claim
can typically move forward. A successful claim can aid a
family in covering damages like medical bills incurred if treatment
existed before death, funeral costs, or loss of financial support from
the victim.
