Bobby Jenkins Jr. and Another Driver Dead in Head-On Collision is Waskom, Texas
According to KLTV reports, two people were killed in a head-on collision in Waskom, Texas. The accident happened around 9:30 p.m. Wednesday, October 5 when authorities believe Bobby Jenkins Jr., for unknown reasons, veered into oncoming traffic on Highway 80 and struck a pickup truck. Jenkins and the driver of the pickup were killed in the accident. The driver of the pickup has not been identified, pending investigation.
Commentary Other news reports thankfully list passengers in both the vehicles who are said to be alright. My condolences go out to the victims involved in the accident. In a head-on collision, cursory investigations prove difficult in determining cause. A third party investigation is needed for a liability designation. If the reports are accurate and the man lost control of the vehicle and entered into oncoming traffic, his estate may face fault in a wrongful death claim. For a claim of this nature to be applicable, the state of Texas requires key elements to be met. First, a party must be liable in the accident in question. The party must be determined to have acted negligent in the victim's death. This element is very dependent upon the outcome of the investigation and police reports. When the two are corroborated, the possibility of a claim is increased. From there, a victim must have survivors who are eligible to make a claim on their behalf, and these claimants must be able to show a tangible economic loss as a result of the accident. Without any of these elements, typically a wrongful death claim cannot proceed.
