Commentary The
nature of hit-and-run accidents require an in-depth investigation, as
much of the evidence may not be preserved. This is a particularly
frustrating aspect of these events, as collecting evidence in a timely
fashion is crucial to potential criminal and civil proceedings.
Over the years a number of reasons have emerged as to why
people fail to render aid in an accident, most being of a reckless
nature. Once the details of the wreck are uncovered, there could be
standing for a wrongful death claim. This type of claim is
dependent on a few key elements being met to satisfy the state's
requirements. First, there must be a liable party whose negligent
actions were the result of the victim's death. As you can imagine, this
element is solidified with the independent investigation and police
reports. Secondly, the victim must have survivors who are eligible to
file a claim on the their behalf. Finally, those who are qualified to
make a claim must be able to show tangible economic loss, as a result of
the accident.
