Jacob Mikal Burrell Killed in Hit-and-Run Accident near Mineola, Texas
According to KLTV, a teenager was killed in a hit-and-run pedestrian
accident near Mineola, Texas. The accident occurred around 8:17 p.m.
Tuesday, October 4 when 15-year-old Jacob Mikal Burrell was struck by a
hit-and-run driver on US 69. Burrell was taken to East Texas Medical
Center Tyler where he was pronounced dead at 10:30 a.m. Wednesday,
October 5. Texas Department of Public Safety troopers continue to
investigate the accident, and have not found the driver.
Commentary Hit-and-run accidents are some of the most frustrating
accidents because they prevent any closure from occurring for the family
involved. When the driver is found, an independent investigation, aside
from the police report, is needed to make a liability determination. A
number of factors could be in play here regarding causes of the
accident. Unfortunately, many of these types of events in the
past have produced a driver who has something else to hide, other than
just the pedestrian accident. My experience has shown hit-and-run
drivers to be running due to warrants, possession, and intoxication.
Obviously the latter could find a driver negligent in the accident.
Other factors like excessive speed could deem a party liable and
possibly give survivors of a victim standing in a wrongful death claim.
A successful claim would allow for recovery of damages like
medical bills, pain and suffering, and funeral costs to name a few.
