Rave Club in Dallas, Texas Closed After Death of Matthew Allen
According to WFAA, Dallas police are closing a rave club where drugs
were regularly sold to occupants. The investigations were begun in
response to the death of 19-year-old Matthew Allen, who had a seizure at
the Afterlife club, August 13. Police believe an overdose on the drug
ecstasy led to the seizure. Dallas police have stated they believe the
club owner and employees had knowledge of several drug sales at the
establishment.
Commentary Normally
in an accident like this, I would discuss the legal ramifications of
the actual accident. However, in this tragedy, I'd like to talk about
the ownership and the liability they could face in the death of this
young man. First though, an independent investigation is needed to
uncover extraneous liability issues. A club owner, much like a
homeowner, has a responsibility to provide a reasonable level of
protection on their premises. If the news feed is accurate, and the club
owner and staff had actual knowledge of drugs being exchanged at the
club, this could be enough to bring a premises liability claim against
the owner. Typically a claim of this nature requires three elements to
proceed. First, a party must be in ownership of the property or
establishment in question. Secondly, the party seeking the claim must
have been an invitee or licensee of the property, and in most cases, not
a trespasser. Most of the time, if the plaintiff is an adult, this is
satisfied regarding a business. Finally, the injury must have been the
result of a negligent act. This is probably the most important element
of the three, as the other two are somewhat circumstantial. To reach the
level of negligence, a threshold must be met by the investigation.
Normally this threshold goes back to a reasonableness claim, where the
property owner should have exercised reasonable effort in order to
prevent potential harm.
