Three Killed in Carbon Monoxide Poisoning in Coal Township, PA
According to local news sources, a family of three were killed due to
carbon monoxide poisoning at their home in Coal Township, Pennsylvania.
The Northumberland County Coroner identified the victims as 93-year-old
Wayne S. Maurer, 84-year-old Catherine M. Maurer, and 43-year-old Mary
Jo A. Maurer. It is believed they passed away some time Friday evening,
September 30 from what investigators believe to be a malfunctioning gas
furnace.
Commentary My
condolences go out to the family of this terrible accident. The United
States Consumer Product Safety Commission notes that on average, 170
people die from carbon monoxide poisoning in our nation every year. In
this accident, one of the potential causes has been identified as a
malfunctioning furnace. Certainly this contingency should be addressed
by a third party investigation. If this cause is corroborated, there
could be multiple wrongful death claims against a manufacturer due to
this accident. A product liability claim requires a meticulous
examination of the defect in question, which must then be laboriously
linked to the injury or death. Toxicology reports go a very long way in
proving this link and highlight how the third party investigation should
work in collaboration with the local police department. If a link is
determined between the product and the fatalities, a claim can typical
commence, as a reasonable consumer would certainly not expect death to
be a result of a faulty machine. This reasonable factor forms the basis
for most personal injury law, and indeed a product liability claim.
With a successful claim, survivors of the victim can claim
certain compensation like pain and suffering, emotional distress, and
funeral expenses.
