Two Killed in Texas from Listeria Outbreak in Cantaloupe
The Centers for Disease Control and Prevention have confirmed two deaths in the state of Texas this week, as a result of a listeria outbreak. The CDC notes symptoms from listeria can take upwards of a month to be revealed and expects more illnesses to pop up over the coming weeks.
Commentary I wrote a blog about this produce recall prior to any injuries occurring. Normally, food injuries involve very minor injuries which do not justify the high costs of litigation (although they might in Small Claims court). However, when a fatality occurs from a suspected contaminated product, the situation changes greatly. In a matter like this, where injuries may be occurring at the biological level, a detailed and thorough investigation is needed for liability purposes. An expert is needed to pair the victim's death with the contaminated produce. Defense attorneys are excellent in limiting liability by placing a victim's injuries on another product they consumed or a lifestyle they live. Many states have adopted new laws which relieve a claimant in having to prove a producer was not careful enough in distributing their product, so the focus must stay on coupling the contaminated product with an illness. From this, a wrongful death claim can potentially be made if the victim has eligible survivors who can make a claim on their behalf. Survivors must be able to prove a tangible economic loss as a result of the victim's death, which are usually manifested in the form of medical bills and pain and suffering.
