Diana DeLeon Killed in Pedestrian Accident in Houston, Texas
According to local reports, a woman was struck and killed by a
hit-and-run driver in Houston, Texas. The accident happened around 2
a.m. Saturday, September 24 when Diana DeLeon was hit by a small black
four-door vehicle, who then fled the scene. The Harris County Sheriff's
Department is investigating the accident.
Commentary Hit-and-run accidents are particularly frustrating for me.
Not only was a life taken, but without the other party more questions
are left unanswered than not. In a situation like this, an independent
investigation is crucial in determining the circumstances of this
accident and assigning liability. Over the years my firm has taken on
many hit-and-run drivers, and as I would bet many of you assume, some of
the matters produced charges beyond just failure to render aid.
Unfortunately, often times these types of accidents reveal a driver who
was under the influence of something prior to the accident. I do find
the timing of this accident on a weekend to be suspicious.
Call this an experienced guess, but if a scenario like
drinking and driving were to emerge from this tragedy, there could be
other liable parties involved, and certainly additional charges for the
driver (and yes, the police will find this person). I mention 2 a.m. as
being suspicious because this is when the bars close in Texas. If a
driver was over-served, allowed to drive, and then involved in an
accident, in addition to their own legal troubles (like a wrongful death
claim), a bar or restaurant could face partial liability in the
accident. Texas' dram shop laws allow an entity like this to be included
in a personal injury or wrongful death action, as the state of Texas
views alcohol given to a person who is already intoxicated, as one of
the causes in drunk driving accidents. Several states have
adopted these laws over the past few decades in an effort to give a bit
more enforcement to their liquor licensing authorities. In many states
these authorities are only given the power to levy small fines against
reckless bars, and dram shop legislation adds a bit of muscle to this
discipline.
