Jourdan Moore Killed by Underage Hit-and-Run Driver in Bellmead, Texas
According to local reports, a teenaged boy was killed in a hit-and-run accident in Bellmead, Texas. The incident occurred Thursday evening around 9 p.m., September 22 when 14-year-old Jourdan Moore was struck by a 14-year-old female driver. Bellmead police received an anonymous tip which referred them to the teenager who fled the scene.
Commentary This is an incredibly sad story. My thoughts are with the family of the victim in this terrible accident. Because of the fact-pattern of this collision, an independent investigation is needed to determine liability. I would rather not discuss the actions of this teenager. I think we can all agree this young girl should not have been driving, and that's that. Moving on, I'd guess my question is the same as many of yours right now. Where were the parents of this girl? If they had knowledge of this teen's use of the vehicle and failed to intervene, they could face the responsibility of this accident. Under Texas law, a wrongful death claim needs one main objective met, and other subset objectives. The victim's death must be the result of a negligent party's actions or inaction. In other words, not acting in a situation can sometimes be as destructive as acting. An underage driver on the roadway is an incredibly dangerous thing that should be prevented. From there, the victim must have survivors who can show they have incurred some type of financial loss as a result of the accident. I do certainly understand it is a very difficult matter to think of a civil claim so quickly following an accident. But what many removed from situations like these do not realize is the financial obligations involved in the loss of a loved one, and the weight they place upon a family. A claim will not bring the victim back, but will go a long way in aiding the healing process.
