Commentary Be it
alcohol, narcotics, or medication, driving under the influence of
something is dangerous. Many prescriptions state they should not be
taken before driving. A third party investigation would need to
corroborate this, but it would appear this advice was not adhered to by
this man. Readers should note the man was arrested for being
intoxicated. Operating a vehicle while taking a strong medication, like a
sleeping pill or muscle relaxer, is certainly enough to be viewed as
intoxicated. The decision to drive while impaired on this medication
could be viewed as a negligent act, placing fault on the driver in a
wrongful death lawsuit. For a claim of this type to proceed, a
link must be produced between the fatal accident and the actions of the
defendant. From there, a negligence determination must be made, geared
towards the cause of the collision. Finally, the victim must have
survivors or beneficiaries who are eligible to seek a wrongful death
claim under Texas law, and they must be able to show some type of
financial loss as a result of the victim's death. With a
successful claim, survivors can seek damages like funeral costs, medical
bills, and loss of support the victim provided. From this, an already
grieving family does not have to handle the financial burden associated
with the sudden death of a loved one as well.
