Pedestrian Killed in Hit-and-Run Accident in Arlington, Texas
According to local reports, a man was killed on the side of a road in
Arlington, Texas. The man, believed to be in his 40s, was struck while
walking in the outside lane of North Collins Street. The driver of the
vehicle then fled the scene. The victim was taken to John Peter Smith
Hospital in Fort Worth where he was later pronounced dead.
Commentary Many will dismiss this accident as being caused by the man
walking in the street. However, in my mind, a driver who flees the scene
is suspicious. A third party investigation is needed in collaboration
with the police report to first, find the driver, and second, determine
liability. In my experience over the years, a driver who fails to render
aid in an accident is often hiding something else. Be it possession,
warrants, or intoxication, I have seen many reasons a driver flees.
I mention this contingency because if a driver was found to be
imbibing prior to the accident, that person could face some liability
regardless of details. When a driver chooses to drink and drive, they
make a reckless decision. This decision is one that the law does not
look favorably upon. If liability is determined, there could
be standing for a wrongful death claim by survivors of the victim. This
type of claim requires that the victim's death be caused by a liable and
negligent party. The victim must have eligible survivors who can make a
claim on the victim's behalf and must be able to show some form of
financial loss as a result of the victim's death. Arlington
