Motorcyclist Johnny Hawthorne Killed Following Collision with Vehicle in Fort Worth, Texas
Local reports indicate a man was killed after his motorcycle was struck
by another vehicle in Fort Worth, Texas. The accident occurred
Wednesday, September 14 when the motorcycle driven by 47-year-old Johnny
Hawthorne was struck by a vehicle that police say made a left turn
without yielding, causing the crash. Hawthorne was taken to John Peter
Smith Hospital where he was pronounced dead Monday, September 19. Fort
Worth police state investigation of the wreck is ongoing.
Commentary When I first heard of this accident, I hoped the
motorcyclist would make it. Tragically, he did not. A third party
investigation is needed to determine liability. If the reports are
accurate and the driver of the other vehicle failed to yield to the
motorcyclist, that could be enough to make a liability determination
against the driver. You see, a determination of this nature
requires a meticulous fact-finding mission to recreate the accident.
From there, an examiner pairs the facts with a decision of
reasonableness. To have standing for a wrongful death claim (in vehicle
accident), a person must have breached the duty they have to operate
their vehicle in a safe manner. A breach of duty can come from many
events, like driving with excessive speed, operating under the
influence, or failing to yield right-of-way to an oncoming vehicle. From
there, the victim must have eligible survivors who can file a claim on
behalf of the decedent and can show tangible monetary loss as a result
of this accident. With a successful claim, a family does not have to
worry about the financial burdens associated with the loss of a loved
