Franklin Walton Killed in Wrong-Way Collision in Longview, Texas
Local reports indicate a man was killed following a wrong-way collision
in Longview, Texas. The accident occurred around 2:47 p.m., Sunday
September 18 when 32-year-old Raina Romero was traveling east on Dundee
Road when she veered into oncoming traffic to avoid a vehicle who had
stopped in the roadway. Romero then struck a car driven by 44-year-old
Jerri Fort. Fort's backseat passenger, 87-year-old Franklin Walton, was
killed in the accident. Passengers in both vehicles were taken to local
hospitals with what are considered non-life threatening injuries.
Commentary These
types of accidents are very difficult for many to deconstruct,. Multiple
parties are involved here, with a couple of different theories of
liability to sift through in this tragic wreck. To begin, an independent
investigation is needed to determine liability and recreate the
accident. In an incident like this, where there could be two parties at
fault, the investigation must be conducted by an expert in the field of
automotive accidents. The expert should point their focus
towards both the stalled vehicle and the vehicle that swerved into
oncoming traffic. A few questions come to mind that could go a long way
in determining fault. Did the driver swerve to avoid a disabled car, or
was traffic at a standstill and the driver was not paying attention? The
former could at least partially implicate another motorist, while the
latter probably faults the swerving driver. Furthermore, a speed
determination is crucial to this accident, as it would explain the
actions of the car that struck the vehicle of the decedent. Determined
liability could allow standing for a wrongful death claim, possibly
against multiple parties. As you can see, the contingencies in
a multi-vehicle accident are such that only a proper investigation will
suffice in providing appropriate compensation to a family who has just
lost a loved one. These accidents are incredibly detail-specific and
require an examination, beyond the police report, to occur.
