Lisa Mireles Killed Following Wreck with Suspected Drunk Driver in Duarte, CA
According to local reports, a woman was killed when her vehicle was struck from behind by a suspected drunk driver in Duarte, California. The accident happened around 11 p.m. Friday, September 16 when 43-year-old Lisa Mireles was killed after her car was rear-ended by 30-year-old William Segura who police believe was traveling well over the speed limit. Police report the collision caused Mireles' car to veer off the road and hit a tree. Segura then fled the scene on foot but was later arrested.
Commentary Drunk driving continues to claim the lives of good people all over the country. To begin, a third party investigation is needed to determine all liability possibilities. Certainly an intoxicated driver could incur great liability in a wrongful death claim, as the law views this as a reckless act. For a claim of this nature to proceed, typically a few elements are needed. The victim's death must be the result of a negligent party's actions or inaction. The alleged alcohol use probably makes this easily definable. The victim must have survivors or beneficiaries who are eligible to make a claim on the victim's behalf. The survivors must be able to show a tangible economic loss as a result of the victim's death, which are usually manifested in funeral costs, pain and suffering, or loss of financial support the victim provided. Unfortunately in California, there are no laws to allow for a bar or restaurant to be named in a wrongful death suit. Some states like Texas, hold laws called dram shop laws, which allow for a bar or restaurant to be sued in the event they over-served a patron who was then involved in an accident. California's only laws with respect to vendor liability revolve around the selling of alcohol to minors.
