Commentary Giving medication of any kind to a child that young requires meticulous attention and dosing. This is a tragedy that did not need to happen. A third party investigation is needed to corroborate the police report and determine business standing. I mention the latter as home day cares are sometimes incorporated individually, other times are incorporated as a subset of another day care, and other times are not incorporated at all. This is very relevant as compensation for this terrible accident is dependent upon this determination. Wrongful death claims typically need a few elements to go forward. First, a party must be found liable and negligent in the victim's death. There must be survivors, beneficiaries, or close relatives who can make a claim on the victim's behalf, and they must be able to show financial loss, as a result of the death. This compensation will go a long way towards beginning the healing process.
