Terry Harold Farris Killed in Hit-and-Run Accident in Waco, Texas
Local reports indicate a man was killed in a hit-and-run accident in
Waco, Texas. The accident happened Tuesday, September 13 when
53-year-old Terry Harold Farris was crossing North 18th Street when he
was struck by a light-colored SUV. The driver then fled the scene.
Farris was taken to Hillcrest Baptist Medical Center where he was
pronounced dead upon arrival.
Commentary Hit-and-run accidents are some of the most annoying
incidents in the personal injury field. In my experience, drivers who
flee the scene of an accident typically have more to hide than just the
wreck. Several of these instances have produced drivers who hold
additional charges like possession, driving under the influence, or
outstanding warrants. Certainly I am guessing here as to the reason
someone fails to render aid, but it really does not matter. A third
party investigation is needed to determine liability and recreate the
accident. When the police catch the driver (and they will), he could be
subject to a civil claim in addition to at least one criminal charge.
Regarding the civil matter, a wrongful death claim can proceed
if a few elements are involved. First, the police report and subsequent
investigation must determine a party liable, and furthermore negligent,
in the death of the claimant. The deceased must have survivors or
designated beneficiaries that are eligible to file suit on the
decedent's behalf. Lastly, they must be able to detail a financial loss
as a result of the victim's death. Logistics of the claim
aside, I hope the police find this driver. While closure is certainly
not going to occur so soon after the accident, dragging out the ordeal
by trying to find the driver only prolongs the pain.
