Crossing Guard Frank Luttrell Killed On-Duty in Ankeny, Iowa
Local reports indicate a man was killed while performing crossing guard
duties in Ankeny, Iowa. The accident occurred Thursday morning,
September 15 when 78-year-old Frank Luttrell was struck preparing to
take a group of children across West First Street. With reflective vest
on and stop sign raised, Luttrell was hit by 63-year-old Laurin J. Cole.
The victim was taking to Mercy Medical Center in Des Moines, where he
was later pronounced dead.
Commentary This is
an incredibly sad accident. Another news feed detailed an interview
Luttrell gave to a local newspaper where he urged drivers around school
zones to be more cautious. I wish the man's plea was present Thursday.
A third party investigation is needed to determine liability,
recreate the accident, and figure out what happened that morning.
Luttrell was absolutely correct. A distracted driver is a very dangerous
entity, and to be distracted in a school zone borders on being
deplorable. If the investigation does indeed find a driver who was
distracted at the time of the accident, this could lay fault at the feet
of the driver in a wrongful death claim. This type of claim
seeks to compensate a grieving family in the event a loved one is killed
by the negligent actions of another party. For the claim to proceed,
the investigation needs to determine liability on the other party, and
there must be survivors of the victim who are eligible to file a claim.
Lastly, the survivors must be able to show tangible economic loss,
usually in the form of medical bills or lost income the victim provided.
