Jesus Alberto Acosta Charged in the Death of Man on US59 in Montgomery, Texas
According to local reports, a man has been charged in a fatal car
accident in Montgomery, Texas. 20-year-old Jesus Alberto Acosta faces
criminally negligent homicide in the death of a 40-year-old male, killed
on Eastex Freeway around 8:15 a.m. Wednesday, September 14. Witnesses
believe Acosta was racing along the freeway with other vehicles when he
struck a vehicle that then struck the victim's motorcycle. The
motorcycle slid sideways across the highway. The victim was taken to a
local hospital where he was pronounced dead.

racing is illegal and more importantly, incredibly dangerous. My
condolences go out to the victim's family in this tragedy. A third party
investigation is needed to determine liability, but if the reports are
accurate and one man's erratic driving caused an accident, he could face
fault in civil procedure. Excessive speeding, on any venue, is a
dangerous act which the law views as reckless in a liability
determination. This liability could translate to standing in a wrongful
death claim. To have a cause of action in a wrongful death
claim, a few elements must be present. The victim's untimely death must
be a result of the actions or inaction of a liable and negligent party.
This speaks to the necessity of a third party investigation, which can
be used in corroboration with the police reports to shore up liability.
Next, the decedent must have survivors or beneficiaries to file a claim,
and these people must be able to show financial loss as a result of the
accident. I certainly acknowledge the difficulty in thinking
about a civil claim shortly after a loss of life. However, dealing with
such a tragedy is even more difficult when bills associated with a death
start to pile up. This makes the grieving process that much harder.
