1-Year-Old Aolani McCray Killed in Hot Vehicle at Day Care in Akron, Ohio
According to local reports, a 1-year-old was killed after being left in a sport-utility vehicle in Akron, Ohio. The accident occurred Friday, September 2 when 42-year-old Lisa Scott left Aolani McCray in the back of the vehicle. Scott has been charged with reckless homicide and child endangering.
Commentary This is a terrible tragedy, there is absolutely no other way to describe the accident. While an independent investigation is needed for liability purposes, if the reports are accurate and the woman did indeed leave the child in a vehicle on a warm day, she could face liability in a civil claim. Many states, like the state of Texas, allow for a claim against a worker of the entity where the tragedy occurred. Negligent supervision is the most common of these claims, which essentially alleges that a worker at a day care failed to uphold their duty in keeping a child safe. Furthermore, a less common but still used theory of liability in matters like this is negligent entrustment. This type of claim requires the investigation of the entity itself in their practice of entrusting the worker to watch over the children. Issues like inexperience or a criminal background could implicate the actual day care in a civil claim.
