Rudolfo Telles Killed, Jimmy Soliz Injured in Pedestrian Accident in Amarillo, Texas
According to local reports, a 67-year-old truck driver was killed and another trucker injured in a pedestrian accident in Amarillo, Texas. The accident occurred around 8:25 a.m. Tuesday September 13 when the two drivers were talking on the side of South Lakeside Drive. A Dodge Charger approached the two, striking one of the trucks and hitting both the drivers. One of the truckers was killed, while the other was taken to a local hospital with what are thought to be non-life threatening injuries. Police have not identified any of the men involved.
Update: Police have identified the decedent as 67-year-old Rudolfo Telles. Injured was 50-year-old Jimmy Soliz. The driver has been identified as 28-year-old Willie Adams.
Commentary The news feed does not do an adequate job detailing how this accident occurred. When dealing with a fatal accident, details are everything in defining fault. A third party investigation is needed to determine liability and recreate this accident. An expert would need to decouple the drivers standing in the road with a car driver who may have been reckless in their operation. Any indication of excessive speeding or driver inattentiveness could fault the driver in a wrongful death claim. This type of fault in such a fact-specific incident is only assigned via proper reconstruction. To determine if a claim is applicable, Texas law requires certain criteria to be met. Namely, the death of the victim must be attributed to the negligent actions or inaction of a faulted party. The victim must have survivors who can file a claim, and those survivors must be able to prove economic loss has resulted because of the accident.
