Passenger Jose Perez Killed in Rollover Accident in Houston, Texas
Local reports indicate a San Jacinto College soccer player was killed
riding in car that ran a red light in Houston, Texas. The accident
happened around 7:30 a.m. Tuesday, September 13 when police say the
driver of a BMW carrying 18-year-old Jose Perez ran a red light and
collided with another vehicle. Perez died as a result of the accident.
The driver was taken to a local hospital with minor injuries, while the
other two passengers experienced minor injuries but were not taken to a
hospital. Officials are investigating the accident.
Commentary Fatal
car accidents are all tragic, but accidents involving young people add
another element to the tragedy. An independent investigation is needed
to determine fault, but if the police report is accurate and the driver
of the vehicle ran a red light, that person could face liability in a
wrongful death claim by survivors of the victim. I understand
the difficulty in deciding on a civil claim after a tragedy, but having
to bear the financial loss of a loved one, in my opinion, is worse. A
claim of this nature needs a few elements to have standing. First, the
victim's death must have been caused by the negligent actions or
inaction of a liable party. This element is very fact-specific and shows
why a third party investigation is needed to corroborate this
liability. The claim must be filed by survivors of the victim who can
show tangible financial loss in the victim's death. This loss is usually
manifested in the form of medical bills, pain and suffering, and
sometimes lost income, though this may not be relevant here.
Again, thinking about a civil claim when a tragedy occurs is a
challenging thing, but can be made worse by the economic burden of an
untimely loss of life of a loved one.
