Local reports indicate a woman was struck and killed on the side of
Interstate 10 in Beaumont, Texas. The accident occurred around 5 p.m.
Wednesday, August 31 when 27-year-old Mauquita Tina Smith was struck.
The woman was standing in front of her car in the left lane when a
pickup struck her car, which then hit her. She was thrown into oncoming
traffic and struck again by a driver who fled the scene. Beaumont Police
continue to investigate the incident.
Commentary What a terrible tragedy in south Texas. I would caution
readers who quickly assign blame to the victim for being in the roadway
to think about that response first. Do disabled motorists not have any
right to safety in the event of a breakdown? A third party investigation
is needed to determine liability and recreate the accident. If the
driver who struck the woman's vehicle was found to be speeding or
driving erratically, he could face fault in a wrongful death claim.
Furthermore, while I don't want to implicate anyone, the driver who
began the accident should be checked for any intoxicants in their
system. Alcohol or drug use, irrespective of the facts of the incident,
will often hold some liability. With a determination of fault,
there could be standing for a wrongful death claim by survivors of the
victim, seeking damages like medical bills, funeral costs, pain and
suffering, and loss of support the victim provided.
