Michael Maruska Killed in Motorcycle Accident in Grand Prairie, Texas
Local reports indicate a man was killed on a motorcycle in Grand
Prairie, Texas. The accident happened around 4:40 p.m. Tuesday September
6 when 52-year-old Michael Maruska was riding his Honda motorcycle
along Lake Ridge Parkway when a van, driven by 20-year-old Khoa Nguyen
pulled in front of his path. Maruska was taken by helicopter to
Methodist Dallas Medical Center where he died Friday, September 9.
Commentary The law
does not make a distinction between a motorcycle and a passenger vehicle
on the roadway, but just from a personal standpoint, motorcycles should
be treated with a bit more care on the roadway. With the higher chance
of risk incurred from a motorcycle wreck, more deference should be given
to safety. To understand this accident, a third party investigation is
needed to determine liability. If the police reports are accurate and
the driver of the van pulled in front of the motorcycle, causing the
crash, the driver of the van could face fault in a wrongful death claim.
This type of claim can seek two types of damages, wrongful
death and survival. Wrongful death damages address issues like funeral
costs, medical bills, emotional duress caused from the accident, and
loss of support the decedent provided. Survival damages can only be
filed by one relative, and they include issues like property damage,
lost wages (of the decedent), and medical costs before the decedent's
death. I certainly understand how difficult it is to think
about proceeding with a civil claim following a loved one's death. In my
opinion, it is even more difficult to handle the financial burden of
losing that loved one.
