Edgar Tobar Killed in Industrial Accident in Annandale, Virginia
According to local reports, a man was killed at a work site in
Annandale, Virginia. The accident occurred Saturday afternoon, September
10 when 40-year-old Edgar Tobar was run over by an asphalt roller in a
construction area. Tobar was taken to a local hospital where he was
pronounced dead. OSHA is investigating the accident.
Commentary We are
making progress in safety in the construction field, but we are not
there yet. It is still a dangerous and volatile profession. A third
party investigation is needed to determine liability in the accident.
However, Virginia's workers' compensation may block survivors of the
victim from bringing a claim against the employer. One of the key
tenants of workers' comp is the guaranteeing of benefits by employers,
in exchange for the inability to sue by the employee. The system may
function somewhat fairly on a level where minor work injuries are
involved, but how can a statute fairly predetermine compensation in a
work-related fatality? The way it works in most states is this statute
places a percentage on the worker's wages to calculate compensation. I
would like to think it was not intended this way, but unfortunately this
calculation can often leave the family woefully undercompensated in the
face of mounting bills like funeral costs or medical bills incurred
prior to death. Furthermore, if the decedent was the primary breadwinner
of the household, the strain is even more tangible. Because of this and
other reasons, I have never thought the system to be fair in
compensating a family and beginning the healing process.
