Kevin Jessup Killed in Crash with Alleged Drunk Driver in Farmingdale, New York
According to local reports, an off-duty police officer was killed following an accident with a suspected drunk driver in Farmingdale, New York. The accident occurred around 5:30 a.m. Sunday September 11 when 25-year-old Kevin Jessup was struck from behind by suspected drunk driver Jonathan Lopez. Jessup was taken to Nassau University Medical Center where he was pronounced dead.
Commentary Once again, drunk driving is taking the lives of good people around our nation. It is an epidemic that needs to be stopped. While an independent investigation is needed to determine liability, if the man was indeed found to be intoxicated prior to the accident, he could face great liability in a wrongful death claim. When a driver makes the decision to imbibe and then drive, he not only endangers himself, but every other motorist on the roadway. The law views this as a reckless act that can typically incur fault on a driver. What others may not know is the state of New York holds laws, called dram shop laws, that could hold a bar or restaurant partially liable in a civil suit. The laws seek to enforce the rules that license these alcohol-serving establishments, by allowing them to be named as a third party in a claim. Personal responsibility is not decreased in a claim like this, as the driver is still held liable as well. Rather, the laws seek to balance the interests of patrons with the bar's interest in making money off them. One can see how this type relationship can produce dangerous results in the hands of a negligent entity.
