Joshua Francis and Bradley Morrow Killed in Head-On Collision Near Canadian, Texas
According to local reports, two people were killed following a head-on collision near Canadian, Texas. The accident occurred Wednesday afternoon, September 7 when Texas Department of Public Safety officials say 44-year-old Bradley Morrow swerved into oncoming traffic and hit a semi truck, driven by 30-year-old Joshua Francis. The impact caused the semi to roll on its side and catch on fire. DPS pronounced both men dead at the scene.
Commentary I will admit, many of my blogs involve a dissection of a few trucking companies' inconsistencies regarding safety. While an independent investigation is needed to determine liability in this tragedy, there could be great fault placed on the non-commercial motorist. If the police reports are accurate and his vehicle ended up traveling the wrong-way on State Highway 33, that could implicate the man in a wrongful death claim. Typically these claims need a few things to have standing in court. First, the decedent was killed via the actions or inaction of another negligent party (negligent being the key word there). The victim must have eligible survivors or beneficiaries that can file a claim, and these people must be able to show they incurred some form of financial loss as a result of the accident. With these components, a wrongful death claim can commence. As you can probably tell, the most tricky of these elements is proving the accident was a negligent act. This proves the worth of the independent investigation, as police reports are not written with civil suits, and a different standard of law, in mind.
