Ashley Fewell Killed in Accident with 18-Wheeler in La Vernia, Texas
Local reports indicate a woman was killed in an accident with an
18-wheeler in La Vernia, Texas. The accident occurred before 7 p.m.
Friday, September 9 when 21-year-old Ashley Fewell was struck by an
18-wheeler. She was pronounced dead at the scene by the local Justice of
the Peace. No further details regarding the accident or the truck
driver were available. Texas Department of Public Safety troopers
continue to investigate the accident.
Commentary Details
of this accident are incredibly limited but I can say this is a terrible
tragedy. When an accident occurs with an 18-wheeler, without question
an independent investigation is needed to determine liability. A number
of factors could be involved here to determine fault. The assumption by
many not versed in these types of accidents is typically driver error,
with most implicating one driver against the other. Rarely however, is
an accident with a semi truck just an accident. These machines hold
millions of components, and failure in any of which could place
liability on a trucking company or manufacturer in a wrongful death
claim. My readers would be very surprised (and probably a bit dismayed)
to hear how often we find trucking companies with sketchy maintenance
records and a fleet of vehicles in need of servicing. The
majority of trucking companies take safety to heart, but there are
others who hold a deliver-at-all cost mentality to transport. In the
absence of the aforementioned investigation, these inconsistencies would
never be extolled, as police reports do not usually target third party
causation.
