Kristina Pinna Killed in Construction Zone Accident in Lino Lakes, MN
According to local reports, a woman was killed and others injured in a
multi-vehicle accident at a construction zone in Lino Lakes, Minnesota.
The accident occurred around 6:22 a.m., Thursday September 1 when
46-year-old Debra Hildenbrand's car was struck from behind at a
construction site by 35-year-old Matthew Hauer, when vehicles began to
slow down. Her passenger, 20-year-old Kristina Pinna, was killed in the
accident. Hildenbrand was taken to Regions Hospital in Saint Paul, in
critical condition.
Commentary My
condolences go out to the family dealing with two severe situations in
this accident. A third party investigation should be conducted to shore
up liability. If the reports are accurate and the chain-event accident
was caused by the failure to stop of the man, he could face serious
fault in a wrongful death and personal injury claim. Even more so in
construction zones because of pedestrian workers, drivers have a duty to
operate in a safe fashion. It would appear this duty was discarded in
this accident. For a wrongful death or personal injury claim
to exist, there must be a few key elements involved. There must be a
defendant, whose actions or inaction caused the wreck, and that it arose
from some type of negligence. There must be survivors or beneficiaries
to place a claim, and they must be able to show financial loss as a
result of the accident. Defense attorneys will grill those who
make claims on the last issue, calling into question the relationship
family members have with one another in an effort to limit damages. This
type of cut-throat action is only the beginning, as then insurance
adjusters and attorneys will try to invalidate fault or again limit
damages, all for economic gain.
