Jeanne Shea and Mary Spangler Killed in Stop Sign Prank in Circleville, Ohio
Local reports indicate two women were killed following a crash at a stop sign that had been concealed with petroleum jelly and plastic wrap in Circleville, Ohio. 81-year-old Jeanne Shea and 85-year-old Mary Spangler were killed when the two drove through a stop sign and struck another vehicle, Wednesday August 17. Police state two men covered the sign as a prank and face involuntary manslaughter charges.
Commentary What a senseless and completely unnecessary tragedy. A third party investigation is needed to corroborate with the police reports regarding the two men who allegedly committed the prank. Their actions could hold them liable in wrongful death claims, filed by survivors of the victims. For a wrongful death claim to have standing, there are a few elements an accident must possess. The decedents deaths must be caused by the negligent actions or inaction of the liable party. The decedents must have surviving family or beneficiaries to file for a claim, and some type of financial loss must have occurred as a result of the accident. If any of these elements are not present, typically a wrongful death claim cannot commence. Just one other note as it relates to this accident. You will notice I never mentioned intent in the above paragraph. The law does not recognize a distinction (in this regard) between intending for the accident to occur or intending to have some fun at others expense.
