Christian Ngongi Struck by Hit-and-Run Driver in Milford, Connecticut
According to local reports, a high school student was killed Friday,
September 2 by a hit-and-run driver suspected of driving under the
influence. 16-year-old Christian Ngongi was walking with a friend along
Coe Avenue in Milford, Connecticut when he was hit by 51-year-old
Anthony Criscio. Criscio initially fled the scene but later returned and
will be charged with second degree manslaughter and driving under the
influence.
Commentary A loss
of life at such a young age makes this accident that much more tragic.
The only thing I can say positive about the incident is at least the man
returned to the scene. With the help of a third party investigation,
liability could be locked up against this man if he was indeed found to
be intoxicated before the accident. This faulting could give survivors
of the young man standing in a wrongful death claim against the driver.
Additionally, if the man was found to be imbibing at a bar or
restaurant prior to the accident, the state of Connecticut allows for
inclusion of these entities in a wrongful death or personal injury
claim, under dram shop laws. The laws hold alcohol-serving
establishments partially liable in the event a patron becomes
intoxicated and is involved in a wreck. A dram shop claim does not limit
liability that the drunk driver incurs, but rather enforces the
policies set forth by the state's alcohol-governing body. Making a claim
of this nature can aid in preventing future incidents originating at
the bar in question.
