Richard Casas Killed by a Suspected Drunk Driver in San Antonio, Texas
According to local reports, a man was struck and killed by a suspected
drunk driver in San Antonio, Texas. The accident occurred around 11:30
p.m. Sunday September 4 when 47-year-old Richard Casas was struck by a
35-year-old man who ran a red light. Casas was taken to University
Hospital where he was later pronounced dead. The injured driver, whose
name has not been released, will be charged with intoxication
manslaughter if he survives, according to San Antonio police.
Commentary Drunk driving accidents are afflicting the state of Texas.
For whatever reason, more and more drivers are choosing to take to the
streets after they have imbibed. I don't know about other firms, but
creeping statistics drives how my office handles these accidents. To
begin, a third party investigation is needed to determine liability and
recreate the setting of the accident. Obviously if the reports are
accurate and the man not only ran a stop light but was also intoxicated,
he could face great liability in a wrongful death lawsuit.
The necessity of a third party investigation, aside from the
police report, reveals it's necessity when the discussion turns to the
inclusion of a third party. The state of Texas has in place what are
called dram shop laws that attempt to hold alcohol-serving
establishments partially liable in the event one of their patrons
becomes intoxicated and is involved in an accident. Certainly the
investigation would need to place the man at a bar or restaurant prior
to the accident. These laws do not take away fault from the drunk driver
but rather balance the interests of the patrons with that of the
establishment's interest in making money off them. As you can see, this
is an inherently dangerous relationship bars have with their customers,
and explain why the legislature has looked favorably upon enforcing TABC
rules.
