Romeo Cruz Rodriguez Killed in Wrong-Way Collision in Howard County, TX
According to local reports, one man was killed and another injured in a wrong-way collision in Howard County, Texas. The accident occurred around 1:42 p.m., Saturday September 3 when police say 33-year-old Thang Ceu was traveling westbound on Interstate 20 when he lost control of his vehicle and swerved into oncoming traffic. Ceu's vehicle then collided with the pickup of 31-year-old Romeo Cruz Rodriguez, killing the man at the scene. Three others in the pickup were uninjured. Ceu suffered minor injuries in the accident.
Commentary The police report does not list a reason for the loss of control of the vehicle but several factors could be involved in this tragedy, including intoxicants, driver inattentiveness, and mechanical failure. A third party investigation, conducted by an expert in the field of automotive accidents, is needed to determine liability. The simple fact of the man swerving into oncoming traffic could be enough for the survivors of the victim to have standing in a wrongful death claim. However, I mention a few scenarios above that could bring a third party into a claim. I point back to an expert being needed because I cannot tell you how many accidents actually begin with mechanical failure. A blown tire, faulty steering, or braking failure could all point liability towards a manufacturer. At my firm, we do not include these third parties simply to expand a lawsuit. Rather, the inclusion seeks to prevent this problem from existing in the future by holding manufacturers and designers accountable to their product.
