Jack Houston Killed on Roadway in Sinton, Texas
According to local reports, a man was killed riding his motorcycle in Sinton, Texas. The accident occurred around 7 p.m., Wednesday August 31 when 65-year-old Jack Houston was struck by an SUV, driven by an 83-year-old man. Police say the SUV driver said he was momentarily blinded by the sun and did not see the man.
Commentary It is rather unfortunate that the state of Texas has one of the highest motorcyclist fatality rates in the nation. I caution my readers to treat each motorcycle on the road like they are a vehicle, allowing proper space for them and abiding by right-of-way laws. An independent investigation is needed to determine liability in this accident, but I can say that an admission of sun in the man's eyes is probably not enough to alleviate fault. If the reports are corroborated and this is what indeed happened, the driver of the SUV could be open to a wrongful death claim by survivors of the victim. This would allow the collection of damages like funeral costs, pain and suffering, and loss of income as a result of this man's untimely death.
