Commentary Details
are minimal at present but this is tragic situation. A third party
investigation is needed to determine liability. If the news feed is
accurate and the driver turned in front of the motorcyclist, while
driving without a license, he could face liability in a wrongful death
claim. When a driver operates their vehicle without a license, the law
assumes they have no recollection of local driving rules and furthermore
have not passed a driving test affirming knowledge of these rules. This
can be a negligent act. Typically for a wrongful death claim
to exist, three key factors must be in place for standing. First, a
death occurred because of the negligent actions or inaction of another
liable party. Next, the decedent has surviving family members or
beneficiaries that can seek a claim. Finally, those who can make a claim
can prove they have incurred some type of financial loss as a result of
this tragic loss. These factors will typically allow for a
grieving family to begin a claim and attempt the restitution process.
