Commentary Out
hiking with her husband, this woman is struck by a driver who witnesses
say was speeding. This is a tragic situation. An independent
investigation is needed to determine liability and recreate the
accident. If the investigation determines the man driving was indeed
speeding, his reckless act could cause him to incur liability in a
wrongful death claim. A claim of this nature usually needs three pieces
to be applicable. First, a person's death can be attributable to the
actions or inaction of a liable party. Next, this action or inaction was
in a negligent fashion. Finally, the decedent has surviving family
members or beneficiaries that have suffered some type of financial loss
as a result of the accident. Typically for a wrongful death claim to be
filed, each one of these elements are necessary.
